Welcome to Make My Day Photos LLC. These Terms & Conditions govern your use of our website, photo booth services, digital photo delivery services, and related services.

By using our services, you agree to these Terms & Conditions.

Our Services

Make My Day Photos LLC provides photo booth and event-related services, including digital photography, photo printing, digital photo and video experiences, event galleries, and electronic delivery of photos and other media.

Specific services vary depending on the package selected by the event organizer.

Digital Photo Delivery by SMS

Make My Day Photos offers an optional SMS service that allows photo booth guests to receive their requested digital photos on their mobile devices.

After taking a photo at a participating Make My Day Photos photo booth, a guest may choose to receive the photo by SMS.

The guest voluntarily enters their mobile phone number on the photo booth touchscreen and requests delivery of the photo.

Providing a mobile number is optional and is not required to use the photo booth.

SMS Consent

By entering your mobile phone number and selecting the option to send your photo, you consent to receive an SMS message from Make My Day Photos containing the requested photo or a link that allows you to view or download the photo.

Consent to receive a photo by SMS applies only to the photo delivery service requested by the guest.

Requesting a photo by SMS does not automatically enroll you in recurring marketing or promotional text messages from Make My Day Photos.

Message Frequency

For the digital photo delivery service, message frequency is based on guest requests.

Generally, you will receive one SMS message for each digital photo delivery request you initiate at the photo booth.

Additional system messages may be sent when necessary to process your request, respond to HELP or STOP commands, or provide information related to the requested service.

Message and Data Rates

Message and data rates may apply.

Your wireless carrier’s standard messaging and data charges may apply to SMS messages sent or received as part of this service.

Make My Day Photos does not determine or control charges imposed by your wireless carrier.

How to Opt Out

You may opt out of SMS messages at any time by replying:

STOP

After submitting a STOP request, you may receive a confirmation that you have been unsubscribed. No additional messages will be sent unless you initiate another permitted interaction or opt in again as permitted.

Other standard opt-out keywords may also be recognized by the messaging system, including END, CANCEL, UNSUBSCRIBE, and QUIT.

Supported Carriers

SMS delivery depends on your mobile carrier, device, network availability, and other technical factors.

Wireless carriers are not liable for delayed or undelivered messages.

Make My Day Photos cannot guarantee that every SMS message or digital photo link will be delivered successfully.

Privacy

Your privacy is important to us.

Information collected through our SMS photo delivery service is handled according to our Privacy Policy.

Mobile information and SMS consent information will not be sold or shared with third parties or affiliates for their marketing or promotional purposes.

Photo Booth Images and Digital Media

Photos, videos, GIFs, and other digital media may be created when you voluntarily use a Make My Day Photos photo booth.

Depending on the event and services purchased by the event organizer, media may be displayed in an event gallery or made available for downloading or sharing.

Digital media may be processed or stored using third-party technology providers that help Make My Day Photos operate its photo booth, gallery, hosting, and delivery services.

Event Galleries

Some events may include online galleries that allow guests or event organizers to view or download media.

Availability, access duration, privacy settings, and download options may vary by event.

Acceptable Use

You agree not to use Make My Day Photos services for unlawful, abusive, fraudulent, harassing, or otherwise prohibited purposes.

You may not intentionally interfere with our equipment, website, messaging systems, galleries, or other technology.

Third-Party Services

Make My Day Photos may use third-party service providers to operate portions of our services, including website hosting, booking, payment processing, SMS delivery, photo processing, and gallery hosting.

Use of certain third-party services may also be subject to the applicable provider’s terms and policies.

Service Availability

We work to provide reliable services but cannot guarantee uninterrupted access to websites, galleries, SMS delivery, internet-connected photo booth features, or other electronic services.

Temporary interruptions may occur because of internet availability, mobile carrier issues, equipment problems, maintenance, or circumstances outside our reasonable control.

Limitation of Liability

To the extent permitted by law, Make My Day Photos LLC is not responsible for indirect or consequential damages resulting from the use or inability to use our website, SMS photo delivery, online galleries, or other electronic services.

Nothing in these Terms & Conditions limits rights or remedies that cannot legally be limited.

Changes to These Terms

Make My Day Photos may update these Terms & Conditions when our services, technology, business practices, or legal requirements change.
